How To Obtain a Learner's Licence

Necessity:

No person shall drive a motor vehicle in any public place unless he holds an effective driving licence issued to him by the Licensing Authority, authorising him to drive the vehicle.

The application required:

1) Application form in CMV FORM 2
2) 3 recent passport size photographs

Minimum Requirements

a. Age Between 16-18

1) The applicant shall have attained the age of 16 years in case of Motor Cycle without Gear.
2) The consent/declaration of the parents shall be given before the licencing authority.

b. Age 18 Years And Above

The applicant shall have attained the age of 18 years in case of motor cycle with gear or light motor vehicle.

c. For Transport Vehicle

1) The applicant shall have attained the age of 20 years in case of Transport vehicle (Auto rickshaw cab, Taxi, Goods Vehicle, Bus etc.)
2) One year driving experience of light motor vehicle is required.
3) The minimum educational qualification is a pass in the 8th Std at the school level.
4) Medical certificate in form No.CMV Form 1 and CMV Form 1-A is necessary in case of transport vehicle

The documents required:

a. Proof of Address: (any one of the following)

1) Passport
2) LIC Policy
3) Electricity or Telephone bill
4) Pay slip issued by any office of the Central Government or a State Government or a Local body.
5) Self swearing Affidavit by an applicant before an executive Magistrate or a First Class Judicial Magistrate or a Notary Public as evidence of address.

b. Proof of Age: (any one of the following)

1) School Certificate.
2) Birth Certificate.
3) Certificate granted by the registered medical practitioner not below the rank of a Civil Surgeon.
4) Self swearing Affidavit by an applicant before an executive Magistrate or a First Class Judicial Magistrate or a Notary Public as evidence of age.

What is the amount of Fees payable?

Fees as per Rule 32 of CMVR 1989.

Where to file application ?

Application for learner’s shall be presented by the applicant before the RTOs/R&LAs of the area concerned.

What is Preliminary test? Whether any exemption is provided?

1) Written test will be conducted for the persons who have passed SSLC or equivalent examination or higher. This test will be of multiple choice objective type.
2) ONLINE computer based tests are being conducted at the RTO/RLA Offices
3) In case of others, Oral test will be conducted.
4) These tests will be conducted by the Inspector of Motor Vehicles.
5) Applicants who are already having driving are exempted from appearing for preliminary test in case additional endorsement of new class of vehicle.

What is the Subject in the Preliminary Test?

1) Traffic signs, traffic signals and rules of the road regulations made under section 118 of Motor Vehicles Act.
2) Duties of driver when his vehicle is involved in an accident resulting in death or bodily injury of a person or damage to property of a third party.
3) Precautions to be taken while passing un-manned railway crossing and The Documents he should carry with him while driving a vehicle

What is to be done failing in the preliminary test ?

Application along with documents will be returned to the failed applicant and he can reappear for retest on the next day.

What is the period of validity of Learner’s licence?

Learner’s is valid for the period of six months and can not be renewed further. In case of expiry of the LL, the applicant needs to repeat the process afresh. Mock Test

How to Obtain Driving Licence?

2) an effective learner licence;
3) appropriate fee as specified in rule 32;
4) three copies of the applicant’s recent passport size photograph;
5) in case of transport vehicles certificate in CMV Form 5 issued by driving training school
6) proof of residence;
7) proof of age;

a. Address Proof: (To produce any ONE of the following)

1) Electoral Roll
2) LIC Policy
3) Passport
4) Pay slip issued by any office of the Central Government or a State Government or a Local body
5) Self swearing Affidavit by an applicant before an executive Magistrate or a First Class Judicial Magistrate or a Notary Public as evidence of address

b. Age Proof: (To produce any ONE of the following)

1) School Certificate

3) PAN Card
4) Certificate granted by a registered medical practitioner not below the rank of a Civil Surgeon
5) Self-swearing Affidavit by an applicant before an executive Magistrate or a First Class Judicial Magistrate or a Notary Public as evidence of age

c. Valid Learner Licence

learner licence issued by an authorised licensing authority which is effective as on the date of application for driving licence as well as on the date of competency test.

Minimum Requirement

a. Age:

For Transport Vehicle

1) The applicant shall have attained the age of 20 years in case of Transport vehicle (Auto rickshaw cab,Taxi, Goods Vehicle, Bus etc.)
2) One year driving experience of light motor vehicle is required.
3) A certificate issued by the registered driving school/training establishment.

For Non-Transport Vehicle

No person under the age of eighteen years shall drive a motor vehicle in any public place:

Provided that a motor cycle with engine capacity not exceeding 50cc may be driven in

a public place by a person after attaining the age of sixteen years
b. Learner Licence

Minimum of 30 days from the date of issue of Learner Licence
Learner Licence should be valid as on the date of application

Test Details

The Inspector of motor vehicles will conduct the test of competence to drive vehicle as per the procedures laid down under the rule 15 of Central Motor Vehicle Rules, 1989. After satisfaction about the driving skills he will Rules, 1989. After satisfaction about the driving skills he will pass.

In case of failure in the first attempt of the driving test, the applicant is eligible to appear for the second appearance only after minimum period of seven days from the date of first appearance.

In case the applicant does not pass even after three appearances, he/she shall not be qualified to re-appear for such test before the expiry of sixty days from the date of such last test.

Where to apply for driving licence?

The applicant shall present himself before the RTO/Sub Divisional Magistrate along with application and documents.

What is the validity of driving licence?

1) Driving licence issued is valid throughout India.
2) Driving licence is issued for 20 years or 50 years of age whichever is earlier.
3) Driving licence issued for transport vehicle will be valid for three years.

Duplicate Licence

A duplicate driving licence will be issued in the following circumstances

1.When the licence is lost or destroyed
2.When the licence is defaced or torn or completely written up

Renewal

For the renewal of Driving License one has to apply to the Licensing Authority along with the following documents:

1. Application in Form No. 9
2. Permanent Driving License
3. Medical Certificate in Form 1-A
4. Three copies of passport photographs, if renewal is to be made in Form 6.
5. Fees as specified in rule-32

Addition of Class

Requirements

1) Valid Driving Licence
2) Valid Learner’s Licence for the category
3) Application in Form No 8
4) Form No 1(Self declaration as to the physical fitness for Non- Transport vehicles only)
5) Form No 1-A (Medical Certificate-for Transport Vehicles only).
6) Fees as prescribed in rule 32 along with user charges

to the jurisdictional licensing authority i.e Regional Transport Office/ Registering & Licensing Authority.

Conductor Licence

Application for grant of Conductor’s Licence :-

(1) An application for the grant of a conductor’s license shall be made in HP Form L Con. A to the Licensing authority of the district where the applicant resides or carries in business and shall be accompanied by.-

1) two clear copies of recent photographs of the applicant;
2) a cash receipt or a treasury challan in token of payment of fee; and
3) a medical certificate of fitness in HP Form IX MC Con along with a certificate showing competence to undertake first aid work in HP Form VIII F.A.B. from Chief Medical Officer incharge of a referral hospital or Sub Divisional Hospital or Rural Hospital or Civil Hospital or Civil Hospital, as the case may be, in Himachal Pradesh.

(2) In the case of an application for grant of a conductor’s license, if the Licensing authority has reason to believe that the applicant is physically unfit to perform the duties of a conductor, it may call upon him to furnish a third copy of his clear and recent photograph in addition to the photographs already furnished and to produce another medical certificate of fitness in HP Form IX MC Con from a Medical Officer of the District concerned for this purpose and the photograph so furnished should be firmly affixed with the application duly signed and sealed by the registered medical practitioner.

(3) Eligibility-

1) is a matriculate;
2) possesses knowledge of the provisions of the Act and the rules made thereunder;
3) is conversant with the duties and functions of a conductor;
4) a sound physique; and
5) gives satisfactory proof of his good character.

(4) Validity:-

Conductor’s Licence shall be valid for a period of three years from the date of issue and shall be effective throughout the State.

International Driving Permit

How do I get an International Driving Permit?

I. Minimum Requirements

Application in Form 4-A

II. Documents:

1) valid driving licence issued by the licensing authority;
2) appropriate fee as specified in rule 32;
3) three copies recent passport photograph;
4) a medical certificate in Form 1-A;
5) valid proof of Indian Nationals;
6) if valid proof of passport; and
7) valid proof of visa,

IV. What is the Validity of International Driving Permit?

Every International Driving Permit issued by a licensing authority shall be in Form 6- A and shall be valid for a period of not more than one year from the date of issue, as the case may be,or till the validity of the driving licence, whichever is earlier.

Application for International Driving Permit shall be presented by the applicant in the office of Secretary, State Transport Authority, Directorate of Transport, Parivahan Bhawan, Shimla-171004.
